1. Term and Expiration

The 212 HVAC LLC Maintenance Plans are for a term of one (1) year from the date issued. This agreement will automatically expire at the end of the one-year term. 212 HVAC LLC may contact the Customer prior to expiration to offer a renewal, but the plan will not be renewed without the Customer’s explicit authorization.

2. Inspection and Eligibility

Pre-Inspection: The maintenance plan is contingent upon a preceding inspection by a 212 HVAC LLC specialist. We reserve the right to disqualify any equipment from coverage based on our findings.
System Exclusions: 212 HVAC LLC services are strictly limited to air-based systems. Boilers and water-based heating systems are entirely excluded from coverage.
Pre-existing Conditions: Any repairs required to bring equipment into a state of acceptable condition prior to the issuing of a maintenance plan will be considered outside of the plan and will be priced separately.
Installation Standards: All units must be installed in accordance with the manufacturer’s recommendations to be eligible for coverage.

3. Scope of Service

Residential Only: Plans apply to residential units only, with a maximum capacity of 5 tons.
Unit Limits: All plans include up to one (1) Condenser unit and one (1) Air Handling unit.
Filter Policy: Routine maintenance includes the labor for filter inspection and replacement. The cost of new filters is not included in the plan. Customers may provide their own filters (must meet manufacturer’s specifications), or we can provide them at an additional cost.
Tiered Repair Discounts: Plan members are eligible for repair discounts based on their active tier: Silver (5% OFF), Gold (10% OFF), and
Platinum (15% OFF). These discounts apply strictly to labor charges for repairs performed on covered equipment. Discounts do not apply to parts, materials, or new equipment.
Service Hours: Tune-ups and repairs will be performed by our specialists during normal business hours: Monday through Friday, 8:00 AM – 6:00 PM.
Tiered Priority Service Windows: 212 HVAC LLC prioritizes service requests based on your plan tier (24-hour window for Platinum / 48-hour window for Gold). These timeframes apply exclusively to normal business hours. While we prioritize dispatching to meet these windows, they are not legally binding guarantees. Response times may be extended without penalty due to severe weather events, extreme city-wide service demand, or parts availability delays.

4. Site Access and Code Compliance

Clear Access: The Customer must ensure our specialists have safe, clear, and unobstructed access to all covered equipment. 212 HVAC LLC reserves the right to charge a standard service fee if a specialist is dispatched but cannot access the equipment due to locked premises, building management restrictions, or safety hazards.
Building Codes: This maintenance plan does not cover the cost of bringing existing equipment or installations up to current local, state, or federal building codes. Any modifications required for code compliance will be billed separately.

5. Payments and Refunds

Due Dates: Payment in full is due within 30 days of billing.
Non-Payment: The maintenance plan will be immediately cancelled if payment is past due. In such cases, any and all work performed will be re-billed separately at standard individual service rates.
Refund Policy: A refund for a purchased or budgeted maintenance plan may be issued within 30 days of the plan start date, provided no service work has been performed. No refunds will be issued for plans cancelled after 30 days.

6. Limitation of Liability

212 HVAC LLC shall not be liable for injury or damage resulting from:

Defects in, or the operation/non-operation of, the customer’s equipment, accessories, or any other equipment.
Malfunctions or disturbances in the electrical supply.
Loss, damage, or claims resulting from fires, lack of material, tampering, or abuse by the customer or a third party.
Government regulations, non-performance due to labor disturbances, wars, or any circumstances beyond our control.

7. Acceptance of Terms

By enrolling in a 212 HVAC LLC Maintenance Plan, the Customer agrees to all terms and conditions listed herein from the date of activation until such time as the maintenance plan expires or is cancelled by either party.
